Simple Property Lift is a free, AI-powered pre-sale home improvement advisor. The Service:

Analyses room photographs you upload using artificial intelligence (Google Gemini)
Suggests improvement projects that may increase your property’s appeal and perceived value
Provides estimated costs, labour requirements, and projected return on investment (ROI)
Links to third-party retailers where suggested products can be purchased
Generates a personalised report that you can save, print, or email to yourself

2. Important Disclaimers

Please read this section carefully. It contains important limitations on what our Service is and is not.

Simple Property Lift is NOT any of the following:

A licensed property valuer or appraiser
A registered real estate agent
A licensed builder, architect or building inspector
A financial advisor

3. Use of Artificial Intelligence

Our Service uses Google’s Gemini AI to analyse your room photographs. You acknowledge and agree that:

AI recommendations are generated automatically by machine learning models and are not reviewed by a human before being presented to you
AI analysis may contain errors, inaccuracies or omissions
AI may misidentify materials, conditions, or features in your photos
You are responsible for verifying all suggestions and exercising your own judgment before acting on any recommendation
The quality of recommendations depends on the quality, lighting and angle of your uploaded photos

4. Your Responsibilities

When using the Service, you agree that:

You own or have permission to upload photographs of the property being analysed
You will not upload photos containing identifiable people without their consent
You will not upload illegal, offensive, or inappropriate content
You will not attempt to abuse, overload, or reverse-engineer the Service
You are solely responsible for any renovation, improvement or purchasing decisions you make based on our suggestions
You will comply with all applicable Australian laws, including local council regulations, building codes, and strata by-laws

5. Third-Party Links & Products

The Service contains links to third-party retailer websites including, but not limited to, Bunnings, Amazon Australia, eBay Australia, and Etsy.

We are not affiliated with, endorsed by, or partnered with any of these retailers unless explicitly stated
We do not guarantee product availability, pricing, quality, or suitability
Any purchase you make through a retailer link is a transaction between you and that retailer, governed by their terms and conditions
We are not responsible for any issues arising from third-party purchases

6. Intellectual Property

The Simple Property Lift name, brand, logo, website design, and underlying code are our intellectual property (or used under licence) and may not be copied, reproduced or distributed without permission
Your uploaded photos remain your property. By uploading, you grant us a limited licence to process them through our AI analysis pipeline for the sole purpose of providing the Service
AI-generated recommendations and reports are provided for your personal, non-commercial use

7. Limitation of Liability

To the maximum extent permitted by law:

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied
We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components
We are not liable for any direct, indirect, incidental, special, consequential or punitive damages arising from:
- Your use of or inability to use the Service
- Any renovation or improvement decisions made based on our suggestions
- Any reduction or failure to increase property value
- Any products purchased through third-party retailer links
- Any errors or inaccuracies in AI-generated recommendations
Our maximum aggregate liability for any claim arising from the Service is limited to the amount you paid to use the Service (currently $0 for all users)

8. Australian Consumer Law

  Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted or modified by agreement.

If the Service fails to meet a consumer guarantee, you are entitled to the remedies available under the Australian Consumer Law, which may include a repair, replacement, refund, or compensation for reasonably foreseeable loss.

9. Indemnification

You agree to indemnify, defend and hold harmless Simple Property Lift and its operators from any claims, damages, losses, liabilities and expenses (including legal fees) arising from:

Your use of the Service
Your breach of these Terms
Your violation of any third party’s rights
Any content or photos you upload to the Service

10. Termination

We may suspend or terminate your access to the Service at any time, for any reason, without notice
You may stop using the Service at any time
Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will survive

11. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated “Last updated” date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

For material changes, we will make reasonable efforts to notify users (e.g., via a banner on the website).

12. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales for any dispute arising from these Terms or the Service.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
